Tarieven afhankelijk van formaat, te vinden op (AB 2011, 33) LANDSCOURANT VAN SINT MAARTEN Jaargang 2016, nummer 20 Datum: 28 oktober 2016 p a g i n a 2 MINISTERIËLE REGELING Nr. 2016/2153 Regulation of the Minister of Tourism, Economic Affairs, Traffic and Telecommunications from Oct , to determine the maximum wholesale price and maximum retail prices for petroleum products (Regulation maximum prices petroleum products) The Minister of Tourism, Economic Affairs, Traffic and Telecommunications, Having considered that it is desirable to determine the maximum permissible wholesale and retail prices for petroleum products; In view of Article 2 of the Pricing Regulation; Article 1 This regulation understands under: a. Sales: selling or offering for sale; b. Retail Price: selling price to the consumer; c. Wholesale price: selling price to retailers. Article 2 DECISION: It is forbidden to sell petroleum products listed in the Annex, against a higher wholesale price and retail price than the price indicated in the table Appendix. Article 3 This Ministerial Regulation, given the urgent importance under Article 127, third and fourth paragraph, of the Constitution, shall go into effect on the first day following the date of issue of the official public bulletin in which it is placed. Article 4 This regulation shall be cited as: Regulation maximum prices petroleum products. This regulation along with the elucidation will be placed on the official public bulletin board. p a g i n a /2153 The Minister of Tourism, Economic Affairs, Traffic and Telecommunications Date:Oct Appendix attached to the Ministerial Regulation from oct regarding the execution of Article 2 of the Prices Regulation (Ministerial Regulations prices of petroleum products). Types of petroleum products Wholesale per liter (retailer price) Gasoline NAf Diesel NAf Types of petroleum products Retail price per liter (consumer price) Gasoline NAf Diesel NAf ELUCIDATION In this Ministerial Regulation, the maximum wholesale and retail prices of petroleum products are established. The prices are listed in the Annex of this Regulation. Article 2 of the Pricing Regulation gives the Minister the authority to issue conditions pertaining to the prices of goods and services, when it is the opinion of the Minister that prices violate or threaten to violate the public interest. Article specific Article 1 governs the definitions. The wholesale price is the highest permissible price at which petroleum products can be sold from the wholesaler to the retailer. The retail price is the highest permissible price at which petroleum products can be sold from the retailer to the consumer. The effective date is the date in which the posted price was set by the international market. Article 2 governs the most recent maximum price for petroleum products, as indicated in the table attached. Due to the fluctuations in international prices of petroleum products, the Ministry of Tourism, Economic Affairs, Traffic and Telecommunication moves to adjust petroleum prices on St. Maarten to follow international tends. Meeting its responsibility to facilitate St. Maarten s sustainable socioeconomic development, the Ministry of Tourism, Economic Affairs, Traffic and Telecommunication monitors and adjusts the prices of petroleum products on St. Maarten as petroleum products are crucial to living and doing business in the country. Petroleum products such as gasoline, diesel, and liquid petroleum gas (LPG) are all used, either directly or indirectly, by all residents for transportation, electricity production and food preparation. These activities are dependent on petroleum products that St. Maarten does not produce itself. As a non-petroleum producing country, St. Maarten is dependent upon petroleum imports from other countries, at prices dictated by market forces. As end consumers have very little impact on the prices of petroleum products, the Ministry of Tourism, Economic Affairs, Traffic and Telecommunication adjusts the prices of the gasoline, diesel and LPG to protect residents from unfair prices that could adversely affect the cost of living on St. Maarten. To fairly and transparently set petroleum prices the Ministry uses a price build-up, beginning with the specific posted market price per product and incorporating all costs and taxes associated with getting the product to the consumer. In so doing, the Ministry eliminates all possibilities of price gouging by sellers. Taking into consideration that market prices may fluctuate at any moment in time, the Ministry monitors prices daily and adjusts local prices accordingly. Any delay in price adjustments could mean unfair prices to consumers and suppliers, a situation that the Ministry wishes to avoid as it is detrimental to the socioeconomic wellbeing of residents. The adjusting of petroleum prices is being done via this decree as the ever volatile nature of petroleum prices makes it essential that the Ministry actively responds to changes in global prices by making local adjustments to follow market trends without excessive delay. The Minister executes the authority to adjust petroleum prices as dictated by the market in an expedient manner as it is not in the best interest of the general public to delay adjustments. For this reason p a g i n a 5 the Minister has decided that the prices shall go into effect on the first day following the date of issue of the official public bulletin in which it is placed. As the previously mentioned petroleum products are needed by all, making them vital social products that can be exploited through unfair prices, the Ministry wishes to protect residents by ensuring fair retail prices that follow the most recent adjustments in market prices. Thus, the Ministry of Tourism, Economic Affairs, Traffic and Telecommunication, via this decision sets the maximum price of gasoline at and the maximum price of diesel at effective 6:00am Thursday 6 th October 2016 which replaces any previous price adjustments. p a g i n a 6 (RECTIFICATIE) MINISTERIËLE BESCHIKKING VAN DE 26 SEPTEMBER 2016 MINISTER VAN ALGEMENE ZAKEN NR.: 2016/-2129 in overweging genomen hebbende: - dat artikel 42, derde lid, van de Kiesverordening, de Minister van Algemene Zaken belast is met het benoemen van de voorzitter, leden en plaatsvervangende leden van de stembureaus voor de verkiezing van de leden van de Staten op 26 september 2016; - dat de minister op 8 september 2016 bij ministeriële beschikking de voorzitter, leden en plaatsvervangende leden van de stembureaus heeft benoemd; - dat tussentijdse wijzigingen van het lidmaatschap van de stembureaus voor de verkiezing van de leden van de Staten op 26 september 2016 moeten worden opgevangen; - dat bij besluit van 13 september 2016 aan de Secretaris-Generaal van het Ministerie van Algemene Zaken is gemandateerd wijzigingen van het lidmaatschap van de stembureaus aan te brengen; gelet op: - artikel 42, derde en vierde lid, van de Kiesverordening; HEEFT BESLOTEN: Artikel 1 1. De ministeriële beschikking van 8 september 2016 wordt ingetrokken. 2. Tot voorzitter, leden en plaatsvervangende leden van de stembureaus worden benoemd de personen genoemd in de bijlage bij deze beschikking. Artikel 2 Deze beschikking treedt in werking met ingang van de dag van ondertekening en wordt in de Landscourant geplaatst. PUBLIC TRANSPORTATION MORATORIUM The Ministry of Tourism, Economic Affairs, Traffic and Telecommunication, hereby informs the general public of the following as it pertains to the Moratorium Policy on Public Transportation Licenses of February 18, The Moratorium Policy on Public Transportation Licenses of February 18, 2014 on the issuance of public transportation licenses remains in force, but has been amended as follows: I. Entities already in the possession of a business license to conduct tours, group/ VIP transport and related activities may qualify for an operational license (T permit), in accordance with the National Ordinance on passenger transport, under the following conditions: a. There should be no outstanding business license or Chamber of Commerce fees at the time of application; b. The business license should have been approved and issued prior to the approval of this amendment; c. In the case of Antillean Sole Proprietorships, the business should have been registered at the Chamber of Commerce prior to the approval of this amendment; d. In case of business expansion, entities will be limited to a max. of 5 T plates; The moratorium remains in effect for new applications for business licenses to conduct public transportation related activities. The amended policy goes into effect immediately after the date of publication and is an addendum to the Moratorium Policy on Public Transportation Licenses of February 18, Copies of the policy may be obtained via the Government website located under the Ministry of Tourism, Economic Affairs, Traffic & Telecommunication, via the Department of Economic Affairs, Transportation & Telecommunication Policies, the National Gazette and facebook page. PURPOSE This policy serves as an amendment to the Moratorium Policy on Public Transportation Licenses of February 18, 2014 and establishes the conditions under which T permits are issued. 2. APPLICATION This policy applies to all new applications for an operational license (T permit), in accordance with the National ordinance on Passenger Transport ( landsverordening personenvervoer ). 3. LEGAL AUTHORITY Public transportation is governed by (1) the National ordinance on Passenger Transport ( landsverordening personenvervoer ), (2) the island decree of August 24, 1970, (3) the Moratorium Policy on Public Transportation Licenses of February 18, 2014 and (4) this policy amendment. 4. GOALS & PRINCIPLES The Ministry of Tourism, Economic Affairs, Traffic and Telecommunication (TEATT/ TEZVT) believes that the existing moratorium is hampering legitimate businesses from operating within the realm of the law and as such a revision of the policy is necessary. 5. POLICY The Minister of Tourism, Economic Affairs, Traffic & Telecommunication, in her capacity, has seen the need in the general interest to amend the existing established moratorium on public transportation licenses. The amendment goes into effect immediately after the date of publication and is an addendum to the Moratorium Policy on Public Transportation Licenses of February 18, The Moratorium Policy on Public Transportation Licenses of February 18, 2014 on the issuance of public transportation licenses remains in force, but has been amended as follows: I.
